A man from Mansfield in Nottinghamshire has been prosecuted under the Environmental Protection Act for dumping garden waste.
Antony Hume, 26, from Egmanton Road in Meden Vale, Mansfield, carried out a garden clearance – and had given the waste to a scrap collector to dispose of without checking they had a waste carrier's licence.
An investigation was launched by Mansfield District Council officers, after waste was found dumped on a service road off Netherfield Lane in Meden Vale.
At Mansfield Magistrates’ Court, Mr Hume admitted a Duty of Care offence contrary to Section 34 of the Environmental Protection Act 1990 – and was ordered to pay a fine of £100, plus legal costs of £361.84 and a victim surcharge of £20.
After the hearing, Mansfield Council’s Portfolio Holder for Public Protection at Mansfield District Council, Councillor Mick Barton, said:
“This case demonstrates how everyone has a statutory responsibility to ensure that anyone removing waste from their property is licensed to do so.
“Fly-tipping is a significant problem in the Mansfield district – and we will always seek to take legal action where possible.
”Residents should check the waste disposer holds a waste carrier's licence and obtain a receipt, which includes the contact number and address for them.”
