Legal Aid

What is legal aid?

Legal aid is the system whereby we are paid through public funds to represent you because you would not otherwise be able to afford to get vital legal representation.

After the huge cuts to legal aid, the scope of legal aid was narrowed, but you can still generally receive publically aided representation in judicial review challenges to detention and removal/deportation (with some restrictions for example if you have made repeated judicial review claims in a way that is perceived as abusing the system).

There are two steps to obtaining legal aid representation and your solicitor can help you with these:

  • We will need to convince the Legal Aid Agency (LAA), that your challenge as ‘merits’, which means that you have some chance of success. A solicitor will normally consider this by speaking to you and looking at your documents.
  • You need to be financially eligible. This is done through a ‘means test’ and you need to be able to show that you are living on a very low income. You will be required to show evidence of how you support yourself. We can help you with this.
