Nicholas Hughes, solicitor in Duncan Lewis public law department, joined several prominent media outlets to discuss the recent developments in the government’s Rwanda plan, and what this means for asylum seekers in the UK.


Nicholas discussed the implications of the Safety of Rwanda (Asylum and Immigration) Bill following its passage through Parliament on Tuesday night. Concurrently, the tragic deaths of five migrants crossing the channel from France to the UK threw further spotlight on the issue.


The controversial Government bill aims to ensure that people arriving by small boat or any another “irregular means” are detained and sent to Rwanda, where their asylum cases would be heard, and if successful, they would be resettled there.


The first flight to Rwanda, due to depart in June 2022, was grounded after the Duncan Lewis public law team were successful in their application to the European Court of Human Rights for an emergency interim measure.


Despite the latest decision, made in November 2023 by the Supreme Court, which unanimously dismissed the Home Secretary’s appeal and upheld the Court of Appeal’s conclusion that the Rwanda policy was unlawful, the bill has now been passed by Parliament.  It will become an act once it receives Royal Assent. Notably, on the day the bill was passed, a devastating incident unfolded in the English Channel, resulting in the loss of five lives, including that of a child.


Nicholas Hughes told the BBC “the bill prevents us from arguing anything in relation to what we argued before the Supreme Court back in November, that Rwanda is not a safe country to remove individuals to. What we are able to make arguments about is in relation to the specific needs of the individuals that we represent”.


Under the policy, clients would be given seven days' notice if they were chosen to be removed to Rwanda, giving our team a "very brief window" to explain to the Home Office why they would be unsafe there. Nicholas assures that “we are protecting vulnerable individuals from being sent to places which may cause them severe harm”, and “we will do everything we can" to prevent clients being sent to Rwanda.
