David Saldanha

Profile / Experience

I am a Consultant Solicitor in the Immigration Department at Duncan Lewis. I act for a broad client base across London in all aspects immigration, asylum, EU, nationality and immigration related judicial review matters.

I frequently appear as an advocate in immigration and asylum appeals before the First-tier Tribunal and Upper Tribunal of the Immigration Asylum Chamber. Further, in the fields of asylum, immigration detention and removal cases, I regularly challenge unlawful immigration decisions by way of judicial review and by appeal to the Court of Appeal. As illustrated by my notable cases, I have been the solicitor with conduct of a number of important immigration cases that have assisted to clarify or change the law.

I act for both privately funded and publicly funded (legal aid) clients and have extensive experience working with the most vulnerable; in particular – victims of torture/trafficking/PTSD, minors and unaccompanied asylum seeking children and those detained and under the Immigration Acts.

I am accredited by the Law Society as a Senior Caseworker of the Immigration & Asylum Accreditation Scheme, this means that I have shown that I have the specialist knowledge and experience in the area of Immigration law as required by the Law Society and can advise and assist publicly funded clients under the company's legal aid contract.

Notable Cases

Court of Appeal

  • Semere [2009] EWHC 335 - I provided a witness statement for this case which was referred to by Blake J in his judgment. My statement served as evidence in that case as to the respondent's practice in respect of serving determinations.

  • G in IA and others Turkey CG [2003] UKIAT 00034 - Solicitor with conduct in this country guidance case which provided guidance on the risk on return for Turkish Kurds to Turkey.

  • YS(Sudan) AA/02692/2006 - Solicitor with conduct in this case which, for eighteen months, was the country guidance in respect of return of non-Arab Dafuris to Khartoum. The Home Office suspended removals to Khartoum pending the outcome of this case, but withdrew the decision in that case and granted the appellant asylum after the appellant’s evidence had been served. Within a few months the Home Office revised their Operational Guidance and accepted that such returns could not take place, obviating the need for country guidance.
