Care Homes Or Nursing Homes

Care Homes/Nursing Homes

Who is my regulator?

Care homes regulated by the Care Quality Commission (CQC) are subject to regular monitoring in order to check whether they meet the legal requirements to provide care.

As a care home regulated by the CQC, there will be a lot of pressure to keep up with changing regulations necessary to sustain the running of your health and social care service, while simultaneously competing for local authority’s tenders.

Care homes registered with the CQC include:

  • Nursing homes; and
  • Residential care homes.

How does the CQC monitor me?

The CQC wants all care homes registered to be;

  • Safe;
  • Effective;
  • Caring;
  • Responsive; and
  • Well-led.

They rate these categories using an extended RAG rating, which they use to record the results of their inspections. The findings are published on the CQC website; any that are unsatisfactory may risk your registration with the CQC, as well as the stability of your service.

How can Duncan Lewis help me as a Care Home/ Nursing Home if the CQC brings proceedings against me?

Duncan Lewis Regulatory Fitness to Practice solicitors have experience supporting care providers who are facing enforcement action from the CQC, during the registration process, during inspection, or as part of tribunal proceedings, with expert advice on how to interpret the ever changing regulations the CQC enforce.

We aim to support care homes dealing with difficult matters relating to the Care Quality Commission, which can often be incredibly stressful, especially since the CQC instigates regular inspections to maintain your registration with the CQC.

The on-going pressure can be overwhelming, but with the help of Duncan Lewis Regulatory Fitness to Practice solicitors, you will have the knowledge and support to get through every stage of your CQC registration.

We can work with you to challenge the results of a CQC rating, including reports you deem to be inaccurate to the care you provide as part of your service. It is essential that we work quickly after any unsatisfactory report to make a difference to the outcome.

We support all care homes with any action taken against them by the CQC including:

  • Unsatisfactory ratings,
  • Tribunal Proceedings;
  • After being issued a Warning Notice; or
  • After being issued a Notice of Proposal.

We treat you as an individual health and social care service and will prepare and represent you fairly throughout.

If you are a care home provider with any professional regulatory query concerning the CQC or have had your registration put under threat, contact Duncan Lewis Regulatory Fitness to Practice solicitors on 033 772 0409.
