Profile / Experience

I am a Director within the Immigration Department at Duncan Lewis Solicitors, based in the firm's Leicester office. I lead a team that represents both privately funded and publicly funded (legal aid) clients, including detained foreign nationals, in all courts across the full spectrum of immigration, human rights, nationality law and judicial review.

My areas of expertise include; applications under the European Economic Area (EEA) regulations, removal cases, complex asylum based matters, and representing detained foreign nationals who are seeking to remain in the UK to seek international protection and/or enjoy family life in the UK in accordance with their Article 8 ECHR rights. I am experienced in conducting appeals before the Immigration Asylum Chamber and handling immigration related judicial review claimant cases. I regularly assist in entry clearance matters including those for spouses, visitors and children.

I am accredited under the Law Society's Immigration & Asylum Accreditation Scheme as a Level 2 Senior Caseworker which demonstrates my skill and expertise in this area of law. This accreditation and the fact that I hold an enhanced DBS disclosure, allows me to represent vulnerable clients through legal aid funding, such as victims of torture, victims of trafficking, clients who suffer from a range of mental health conditions and unaccompanied asylum seeking children in relation to their immigration and nationality matters.

Notable Cases

High Court
  • SSHD V DS (2015) - Solicitor with conduct of the case. Represented a Gambian national in challenging the refusal of his further submissions without a right of appeal. Our application for Judicial Review was initially refused but permission was granted at the oral hearing which led to the Home Office conceding the case and agreeing to reconsider the further submissions. Whilst the Home Office maintained refusal, the client was given a right of appeal the decision.

Civil Court
  • SSHD V I (2016) - Solicitor with conduct. Represented a Syrian national who had been granted refugee status in Cyprus. The client had entered the UK and claimed asylum. The Home Office had considered his claim and whilst accepting that he could not return to Syria, refused his application on the basis that he could return to Cyprus where he had been granted Refugee Status. We were able to successfully argue that the client would be unable to return to Cyprus and the client was granted Refugee Status in the UK.

  • SSHD V L (2016) - Represented 2 minor siblings who had come to the UK from the DRC. They claimed asylum but their account as to why they were claiming asylum lacked essential details as they did not have any information as to the whereabouts of their parents. The Home Office initially refused their asylum claim, however the appeals were subsequently allowed on asylum and human rights grounds.
