Monday, 5 January has this year been nicknamed “Divorce Day”, after divorce lawyers saw a spike in the number of enquiries about divorce before and over the festive season.

A poll has shown that one in five people out of 2,000 married people questioned agreed to stay with their partner over the festive season, but will be considering splitting from them in the New Year.

Divorce instructions are though to increase in January because of the pressure for couples to have a perfect Christmas and New Year together and with family.

Many families face debt problems in the New Year, leading to more pressure on marriages.

The urge to “start afresh” in the New Year is also thought to be another factor in why the first Monday after New Year sees a peak in the number of people seeking legal advice about divorce.

Many people have already approached divorce lawyers before the festive season, with plans to divorce in the New Year.

Divorce courts have in the last year seen a higher number of people representing themselves as “litigants in person” in divorce proceedings, after the government cut Legal Aid for some cases in the Family Division.

The Ministry of Justice wants to encourage couple to resort to mediation in contentious divorce proceedings, rather than pursue legal action against their partner.

However, cuts in Legal Aid for divorce cases means that some victims of domestic abuse may have to face their abuser across a mediation table, domestic violence campaigners say.
