The Environment Agency has taken legal action against a Teesside man, after he failed to comply with an enforcement notice to remove 250 tonnes of waste from a site.

Daniel Walsh, 30, of Derwent Street in Stockton appeared at Teesside Magistrates’ Court after pleading guilty at a previous hearing to one charge of failing to comply with a notice requiring him to remove waste from land at Hope Street, Haverton Hill in Billingham – and a further charge of burning waste on the land.

At Teesside Magistrates’ Court on 12 July, Walsh was fined £1,300 and ordered to pay costs of £1,000.

The court heard that Walsh had also been sentenced in February 2015 for running a waste site without a permit – he was fined £1,000 on that occasion.

After that case, Environment Agency officers attended the site and noted around 250 tonnes of waste – mainly soil, construction and demolition material.

In April 2015, a notice was sent to Walsh requiring him to clear the site by July 30, 2015. On July 31, officers attended land next to the site and saw smoke coming from the compound. On August 4, they attended again and there was no apparent reduction in the waste pile present on the site.

In interview, Walsh accepted that he had received the notice to remove the waste – but said he was unable to clear it in the time frame given.

Waste Transfer Notes were produced which showed some of the waste had been removed – but Walsh admitted that financial difficulties were making it hard to complete the removal of the waste from the site.

After sentencing, Enforcement Team Leader at the Environment Agency in the northeast, Dave Edwardson, said:

“Despite a court hearing last year and a notice to clear the site, Walsh failed to remove the waste and officers saw evidence of burning.

“Illegal waste activity has a detrimental impact on the community and environment, as well as undermining legitimate business.

“We’ll continue to work hard to ensure enforcement action is taken against those who flout the law.”
