Compensation in cases excluding injury as a consequence of crime
General Damages:

are awarded to compensate for pain suffering and loss of amenity arising from the injury sustained. The level of damages is dependent upon the severity of the injury, likely period of recovery time and prognosis. In assessing the damages, the court will have reference to the medical report, previous similar cases and guideline figures given by the Judicial Studies Board.
Special Damages: are actual losses arising from the accident and includes but is not limited to;

  • Loss of income
  • Travel expenses
  • Damage to possessions

In serious cases it is possible to recover damages for example
  • Future loss of income
  • Ongoing and future medical care and related expenses
  • Adjustments to your home
  • Lost opportunity for promotion
  • Pension loss
