A driver convicted of causing death by dangerous driving has been jailed for three years and eight months, after he pleaded guilty at an earlier hearing to causing the death of 24-year-old Ian Wemyss by dangerous driving along the A49 in Herefordshire on 6 November 2015.

Shahram Ali, 28, was the driver of a Mercedes E320 and was travelling along the A49 southbound from Hereford, heading home to Gloucester. The court heard how Ali was dangerously trying to overtake a convoy of lorries near the brow of a hill in the dark.

He was travelling at 60mph on the wrong side of the carriageway when he hit Mr Wemyss head on – Mr Wemyss was was travelling in his Ford Ka in the opposite direction and had no chance of avoiding Ali’s car.

He sustained serious injuries in the road crash and was taken to the Queen Elizabeth Hospital in Birmingham, but died three days later having never regained consciousness.

Ali was charged with and pleaded guilty to causing death by dangerous driving.

The District Crown Prosecutor from West Midlands Crown Prosecution Service, Paul Reid, said:

“Shahram Ali decided to overtake a convoy of lorries when it was clearly not safe to do so. His indefensible decision had tragic consequences, resulting in the death of a young man who had his whole life ahead of him. Our thoughts are with Mr Wemyss' friends and family today.”
